These Terms and Conditions (“Agreement”) govern the use of Element Pack Pro (“Product”) offered by BdThemes (“Company”). By purchasing, downloading, or using Element Pack Pro through AppSumo, you agree to comply with these terms.

1. License & Usage

1.1 License Grant – Upon purchase, you receive a non-exclusive, non-transferable license to use Element Pack Pro for personal or commercial projects as per the selected tier.

1.2 License Tiers –

Tier 1: Personal Package – Use on 3 sites

Tier 2: Business Package – Use on 10 sites

Tier 3: Agency Package – Use on unlimited sites (Includes White label branding)

1.3 White Label Branding – Available for Business Package (50 sites) and above, allowing removal of the Company’s branding and customization with user branding. Reselling or redistributing under a different name is strictly prohibited.

1.4 Usage Restrictions – You may not resell, sublicense, distribute, or share your license with third parties. License keys must be used by the account holder only.

1.5 Ownership – The Product remains the intellectual property of the Company. Purchasing a license grants usage rights but does not transfer ownership.

2. Updates & Support

2.1 Product Updates – Users will receive lifetime updates, including feature enhancements and security patches, as long as the Product is actively supported.

2.2 Support Policy – Support is provided via email, live chat or a support portal for bug fixes, troubleshooting, and usage guidance.

2.3 Support Limitations – Support does not cover custom modifications, third-party plugin conflicts, or WordPress-related issues unrelated to Element Pack Pro.

2.4 Compatibility – The Company ensures compatibility with the latest stable versions of WordPress, Elementor, WooCommerce, and Easy Digital Downloads but does not guarantee compatibility with all third-party plugins and themes.

3. Refund & Cancellation

3.1 AppSumo Refund Policy – Purchases made through AppSumo are subject to AppSumo’s refund terms, including their standard 60-day money-back guarantee.

3.2 Refund Exceptions – Refunds will not be issued after the AppSumo refund period ends. Misuse of licenses, violation of terms, or lack of due diligence before purchase does not qualify for refunds.

3.3 Cancellation – Since this is a lifetime deal, no cancellations apply. Users retain access to the Product for the lifetime of the Product.

4. License Restrictions

4.1 Prohibited Actions – Users may not:

Distribute, resell, or sublicense the Product.

Modify and redistribute under another brand name (except for whitelabel-approved tiers).

Reverse-engineer, decompile, or attempt to extract source code.

Use the Product on more websites than their purchased tier allows.

4.2 License Revocation – The Company reserves the right to revoke licenses without refund in case of policy violations.

5. Liability & Warranty

5.1 No Warranty – The Product is provided “as is” without warranties of any kind, express or implied. The Company is not responsible for software conflicts, data loss, or security breaches.

5.2 Limitation of Liability – The Company shall not be held liable for any direct, indirect, incidental, or consequential damages resulting from the use of Element Pack Pro.

5.3 Security & Compliance – Users are responsible for ensuring their website security, backups, and compliance with WordPress standards.

6. AppSumo Deal Structure

6.1 Lifetime Access – Users receive lifetime access to Element Pack Pro, including updates and support, as long as the Product is actively maintained.

6.2 Code Redemption – Users must redeem their codes via the AppSumo redemption process. Failure to redeem within the redemption window may result in code expiration.

6.3 No Code Stacking – Each purchase tier corresponds to a fixed site limit; stacking codes for additional site activations is not permitted.

7. Termination

7.1 Breach of Terms – Violation of these terms may result in immediate termination of the license without refund.

7.2 Product Discontinuation – The Company reserves the right to discontinue Element Pack Pro with prior notice. Lifetime license holders will retain access to the last available version.

By purchasing and using Element Pack Pro, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
